Constitution (Revised October 1997)


PREAMBLE

We the members of WSYC-FM, Shippensburg University, do unite to establish and maintain this station as a student organization and do adopt for its government this constitution. Our purposes in doing so are to provide a means of entertainment for the student body and community; student training in the field of radio on an informal, non-instruction-oriented basis for our members; to serve the public interest, and to be an instrument of expression for the university community, in accordance with the rules of the Federal Communications Commission (FCC).

ARTICLE I

NAME

The name of the organization shall be WSYC-FM.

ARTICLE II

SHIPPENSBURG UNIVERSITY MEDIA BOARD MEMBERSHIP

The SU Campus Media Board will include representatives from nine groups which either offer services or receive services from the campus media. These groups include: 1) Slate Editor-in-Chief, 2) Slate Advisor, 3) WSYC-FM Radio Station General Manager, 4) WSYC-FM Advisor, 5) Cumberland Editor, 6) Cumberland Advisor, 7) faculty-at-large appointed by APSCUF, 8) Student Association President, 9) Vice-President of Student Affairs (Non-voting except as a tie-breaker).

PURPOSES

The SU Campus Media Board is established to assure a professional approach to the campus media publications/broadcasts and to aid the campus media in being responsive to the concerns of their audience. The board is fully cognizant of the First Amendment constitutional guarantees afforded to student publications/broadcasts and the board's purpose encompasses the fostering of those constitutional protections.

FUNCTIONS

1) To establish the university media guidelines designed to promote the functions of all campus media within constitutional standards. WSYC-FM must operate within the rules and regulations of the Federal Communications Commission.

2) To monitor the products of all campus media to insure that they fall within the context of these guidelines.

3) To advise campus media in matters of content, internal organization, financing, other issues as needed, and to assist in obtaining legal advice for the campus media.

4) To assure that media organizations' individual constitutions are followed when selecting media staffs.

GENERAL GUIDELINES ON DAY-TO-DAY OPERATIONS OF INDIVIDUAL MEDIA ORGANIZATIONS

The Slate Editor-in-Chief, WSYC-FM General Manager, and Cumberland Editor will continue to: 1) work independently; 2) be responsible for the selection of their staff; 3) be responsible for enforcing their editorial and managerial policy; 4) be responsible for supervising their staffs.

Advisors to the newspaper, radio station, and yearbook, as well as the chair-person of the Communications/Journalism Department, will be responsible for providing feedback regarding the needs of the students. The Vice-President of Student Affairs will be responsible for indicating the needs of, and offering feedback for the administration.

MEETINGS

The Vice-President of Student Affairs will be responsible for setting up meetings, taking minutes, and distributing minutes. Two meetings will be scheduled about October 15 and March 1 to discuss observations of the media performance in general and any other agenda items as submitted to board members. Any other meetings will be held only when requested by a media board member(s) to discuss concerns raised by individual(s).

ARTICLE III

WSYC-FM MEMBERSHIP

Section 1:

Any member of the Student Association may become a full member of the station. All members must follow the rules and training procedures of WSYC-FM, the Student Association and the FCC.

Section 2:

A person may become a member without joining the on-air staff with permission of the Executive Council. Graduate students and SU faculty may become members of the on-air staff, but they are not permitted to vote at station meetings. Also, graduate students and SU faculty will not be able to join the on-air staff until all undergraduate members have an opportunity to join.

Section 3:

A full member is a voting member of the station, but may be suspended either by 2/3 signature of the Executive Council on the suspension notice or by violating clearly defined suspendable offenses listed in "Rules & Common Sense." All suspensions must be by 2/3 of the Executive Council. Written suspensions must be issued within seven (7) days from the suspendable offense. "Rules & Common Sense" will be provided by the Program Director, and will be approved by the Executive Council. Suspension is defined as a temporary removal from all station activities that will not exceed 90 days. Suspended members may attend station meetings, but are not permitted to participate in voting procedures. Other activities will be left to the discretion of the General Manager. Suspended members lose seniority, their show(s), staff positions, and station privileges, such as music sign-out, use of the production room, on-air attendance, and use of the office. During periods when the station is off the air, such as summer and breaks, suspension can be imposed only by the General Manager, or by the person specifically designated by the General Manager. This suspension is only valid until the Executive Council assembles, and can pass judgment.

The other method of removal, expulsion, is defined as the permanent removal of a member from all station activities. Expulsion can only be achieved after a 2/3 vote of the Management Council. Expulsive offenses shall be any action which could jeopardize the station's FCC license, or the license of the Chief Operator; willful destruction of station property, or dangerous violations of "Rules & Common Sense."

Section 4:

If a station member is suspended and wishes to appeal the suspension, a written appeal must be submitted to the General Manager within seven (7) days from the date of the suspension. The General Manager will call a meeting of the Management Council to hear the appeal. The Management Council, with the exception of the Executive Council, will hear the appeal, with the suspended member and the two Executive Council members who initiated the suspension having an opportunity to present their cases. The Management Council, with the exception of the Executive Council, will discuss the appeal and then vote by secret ballot. A majority vote is necessary to overturn a suspension.

Note: If the General Manager does not submit the appeal to the Management Council within seven (7) days from its receipt, suspension will be revoked. This is the final decision within the Management Council.

Section 5:

If a suspended member does not have a suspension overturned by the Management Council and wishes to continue the appeals process, or if the member is expelled and wishes to appeal, a written appeal must be submitted to the General Manager within seven (7) days from the appeal meeting or expulsion. The General Manager will call a meeting of the advisor, Executive Council, and the member in question to further discuss the case. If the member is still unsatisfied, a written letter must be submitted to the General Manager within seven (7) days asking for a meeting of the Judicial Review Board. The Judicial Review Board will decide whether to overturn, uphold or shorten the suspension or expulsion, or not to hear the case altogether. If the latter is chosen, the Management Council decision will stand.Note: This is the overall final decision, and the absolute end of the suspension or expulsion process.

Section 6:

Three unexcused absences in a single semester will result in suspension. Excuses from station meetings are to be given in writing to the Personnel Director prior to the missed station meeting.

Section 7:

Station meetings shall be called by the General Manager at least once a month. Emergency meetings may be called by the General Manager or by 1/3 petition of the full membership. 24 hours notice must be given to other station members in every instance. A majority of the full membership is necessary for a quorum.

Section 8:

A DJ or newscaster who misses a show/newscast will be suspended and lose their show/newscast. Show/newscast substitution arrangements are the responsibility of the DJ/newscaster needing the substitution. After such an arrangement has been made, it is the responsibility of the substitute to do the show/newscast or they shall be reprimanded under the above guidelines.

Section 9:

Any member who will be absent from station operations for an extended period of time for a good reason may apply to the General Manager for a sabbatical leave. This will allow the member to return to the station as a full member, rather than to re-apply.

Section 10:

All members are subject to the rules and requirements of the station. Noncompliance with the rules and requirements of the WSYC-FM Constitution is subject to disciplinary action.

Section 11:

No station member shall deter the Executive Council from the execution of their duties. The Executive Council members have the right to all information, records, and documents which are held by any station member, and are of importance to the station. No station member shall misrepresent WSYC-FM by claiming to be a member of the Management Council, nor shall a member open mail or property of any staffhead unless they have explicit approval from that particular staffhead. Also, no station member, except the General Manager, shall contact other organizations for information programming, etc., unless such permission is given. No station member shall perform a department function without prior consent from the appropriate staffhead.

ARTICLE IV

THE MANAGEMENT COUNCIL AND THE EXECUTIVE COUNCIL

Section 1: Executive authority of WSYC-FM shall be vested in the Management Council consisting of: The General Manager, Program Director, and Personnel Director (Referred to as the Executive Council), and other members listed as: Assistant Program Director, Assistant Personnel Director, Business Director, Chief Engineer, Community Contributions Director, Music Director, News Director, Production Engineer, Public Relations Director, Music Librarian, Sports Director, Traffic Director, and other positions deemed necessary by the Executive Council. Also, included on the board, as non-voting members, are the station advisors who are chosen by the Executive Council. The advisors shall be either SU faculty, graduate assistants, or professional broadcast personnel.

Section 2: The General Manager shall serve as the chairman of the council, followed by the Program Director and the Personnel Director respectively. The Personnel Director shall act as secretary of both the Executive and Management Councils, and is responsible for the writing and posting of the meeting minutes. In the Personnel Director's absence, the Management Council minutes will be taken by the Business Director.

Section 3: All three Executive Council Members must be present to call a vote to the Executive or Management Councils. A vote must be made available to any full member upon request.

Section 4: Major decisions of the Executive and Management councils must be announced at station meetings, and minutes to the Executive or Management Council meetings must be made available to any full member upon request.

Section 5: All interpretations of the WSYC-FM Constitution, SA Rules, FCC Rules, and decisions about the following said rules, must be approved by the Executive Council.

Section 6: The approval of appointed officers, adoption and implementation of policy, major program changes, and all other governing powers not elsewhere designated in this Constitution are under control of the Management Council and will require a vote of the council enactment.

ARTICLE V

DUTIES AND POWERS OF COUNCIL MEMBERS

Section 1: General Manager

- The General Manager is responsible for coordinating all station operations, financial, and physical conditions, and the security of the station, as well as keeping station files updated.

  1. Since the General Manager is responsible for the station as a whole, only he or she may remove equipment from the station area. The General Manager must inform the chief operator in writing about any removal of equipment. The General Manager may delegate the power of removal to the Chief Engineer or department head in charge of equipment.
  2. The General Manager is the official representative of the station to all outside concerns.
  3. To insure efficient operation of the office, the General Manager may remove any staffhead from duty if there is just cause. (Exception: members of the Executive Council). The staffhead may, at the time of removal, appeal the decision of the General Manager to the Management Council. In such cases, the Management Council will hold a hearing on the charges brought by the General Manager. A 2/3 vote of council is needed to reserve the General Manager's decision. The General Manager and the staffhead in question can not vote in this type of hearing.
  4. The General Manager shall demand, once a semester, a written report of the activities and achievements of each department.
  5. The General Manager shall have the right and responsibility to make decisions which require immediate action and cannot await the interpretations of either the Executive or Management councils. This includes emergency expenditures and changes in personnel. The General Manager must notify the Executive Council of the immediate actions or decisions as soon as possible.
  6. The General Manager shall submit a five-year plan by October 31 for approval by the Management Council. This plan should include input from the Management Council regarding equipment purchases, community services, and any goals that serve to better WSYC-FM. This plan is to be followed as close as possible when purchasing equipment. Also, the General Manager will submit a report to the Management Council on what actions have been taken on the previous five-year plan.
  7. The General Manager's decisions are subject to reversal by the Executive Council, unless reversal would cause violation of FCC regulations, or obviously threaten the station's relationship with the university or community. The General Manager must be a full member of WSYC-FM in good standing.
  8. The General Manager shall be responsible for the maintenance and upkeep of the "General Manager's Handbook"

Section 2: Program Director

- The Program Director has the responsibility for over the air material. The Program Director is responsible to the Executive Council and consults its officers on major programming concerns, but is responsible to the General Manager in the executive of his duties. The Program Director may change the staff if they are presently insufficient or have broken program rules, but this does not include directors of the various departments that are appointed by the Management Council as described later. The Program Director is directly responsible for the safekeeping and return of all program material, any major format changes, and determining the station's hours of operation. Both must be approved by the Management Council.
OTHER DUTIES:

  • Make rotations weekly
  • Put out all specialty programs weekly
  • Conduct show sign-ups in conjunction with the Personnel Director each semester
  • Establish and enforce rotation
  • Enforce the rules of the WSYC-FM Constitution and "Rules and Common Sense"
  • Weekly paper filing
  • Program all specialty shows for the semester
  • Program public affairs and community programs for the semester, including those listed in the 5-year plan
  • Hand out clock violations
  • Make sure BMI and ASCAP logs are completed and mailed on time
  • Help critique air checks
  • Delegate a portion of duties to the Assistant Program Director
  • Must be a full member of WSYC-FM in good standing

Section 3: Personnel Director

- The Personnel Director is responsible for training every member of WSYC-FM.

OTHER DUTIES:
  • Draw up training program (needs approval of the Executive Council)
  • Appoint staff to help train
  • Give board test and determine if trainee is qualified to be on the air
  • Maintain an updated list of full members of WSYC-FM and post in on-air studio
  • Responsible for maintaining a DJ substitution list
  • Conduct show sign-ups in conjunction with the Program Director
  • Official representative of all station members at Executive and Management Council meetings
  • Responsible for checking attendance at all station meetings
  • Keep minutes, attendance sheets, and documents on file
  • Notify jocks about misses meetings
  • Find substitutions for empty shows, and fill empty shows if necessary
  • Notify, in written form, all jocks of their next semester show assignment(s)
  • Train newscasters, or delegate responsibility to News Director
  • Post and update Station Personnel List
  • Critique air checks
  • Draft DJ contracts and make sure DJs sign agreement
  • Must be a full member of WSYC-FM in good standing

Section 4: Assistant Program Director

DUTIES:
  • Assist Program Director in making rotation
  • Check play lists everyday to make sure clocks and rotation are being followed
  • Issue written warnings to first time violators of clocks/rotations
  • Responsible for maintaining copies of clocks, play lists , and request logs
  • Inform Program Director of all violations
  • Present a list of the most requested songs to the Program Director and Music Director weekly
  • Coordinate the "Top 25 ," most requested songs, to be aired weekly
  • Enforce the rules of the WSYC-FM Constitution and the "Rules & Common Sense"
  • Make sure DJs complete necessary paperwork such as play lists, request logs, etc...
  • Create, oversee, and format programs as seen fit by the Program Director, such as music information, and concert information shows
  • Must be a full member of WSYC-FM in good standing.
  • Responsible to the Program Director

Section 5: Assistant Personnel Director

DUTIES:
  • To help Personnel Director in the training of new DJs
  • To take minutes at all station and Management Council meetings
  • To type, post, and file station and Management Council minutes
  • Aid the Personnel Director in filling empty shows
  • Help critique air checks
  • Must have the equivalent of 25 credits
  • Must be a full member of WSYC-FM in good standing.
  • Responsible to the Personnel Director

Section 6: Business Director

DUTIES:
  • In charge of finances of the station
  • Controls expenditures
  • Sign and secure payment of all contracts
  • Gather all needed information for special budget requests, and submit requested report to Budget & Finance Committee for approval
  • Monitor expenditures of individual departments
  • Prepare and post monthly budget
  • Check with fiscal office monthly to balance books
  • Follow rules and regulations of the Student Association Budget & Finance Committee
  • Compile and submit yearly budget operating requests
  • Must be a full member of WSYC-FM in good standing
  • Responsibility to the General Manager

Section 7: Chief Engineer

DUTIES:
  • Responsible for maintenance of station equipment and facilities
  • Responsible for contacting the contract engineer when needed
  • Shall enforce policies for treatment of equipment and facilities
  • Must clean all equipment and transmitter
  • Keep daily log of transmitter readings
  • Must get explicit approval of the contract engineer to work on the transmitter equipment
  • Responsible for maintenance and upkeep of the "Chief Engineer's Handbook"
  • Must be a full member of WSYC-FM in good standing
  • Responsible to the General Manager

Section 8: Community Contributions Director

DUTIES:
  • Arranging underwriting of WSYC-FM programs
  • Work through the student Association's Extra Curricular Activities Committee and the Fiscal Office of the University in order to receive permission to conduct all fund raising except underwriting
  • In charge of obtaining donors for WSYC-FM
  • Set donorship rates
  • Ensure that donorship spots are produced in a professional and timely manner
  • Comply with donor specifications, contractual obligations, FCC rules, and the station identity
  • Attempt to meet or exceed to income commitment
  • Make sure all donorship contracts are signed by the appropriate people
  • Contact potential new donors and donors whose slots are expired or near expiration
  • Make sure all donors are being played at the proper times
  • Produce or assign production of donorships requiring copy change, as needed
  • Must be a full member of WSYC-FM in good standing
  • Responsible to the General Manager

Section 9: Music Director

DUTIES:
  • In charge of all music owned by WSYC-FM
  • Responsible for constant contact with all music suppliers
  • Request and obtain music
  • Report to trades weekly
  • Preview contents of all songs in rotation with Program Director
  • Responsible for safe-keeping of all music
  • Responsible for working with the Public Relations Director in conjunction with giveaways and promotions
  • Give input for rotation to the Program Director weekly
  • Log all incoming music
  • Responsible for the repurchase of damaged or stolen music along with the Music Librarian
  • The Music Director is in charge of the Music Assistant(s). The Music Assistant(s) will be chosen by the Music Director and will perform tasks the music director deems necessary
  • Responsible with the Music Librarian for organization of WSYC's music
  • Must be a full member of WSYC-FM in good standing
  • Responsible to the Program Director

Section 10: News Director

DUTIES:
  • In charge of all newscasts, special news reports, or talk shows
  • Responsible for producing current newscasts of high quality
  • In charge of providing state, national, international, sports, and weather news through use of the AP wire service
  • In charge of assigning stories to reporters concerning local and campus news
  • Responsible for filling news spots
  • In charge of impartial scripts and outside news sources
  • Responsible for training newscasters, if delegated by the Personnel Director
  • Responsible for following FCC guidelines
  • Must be a full member of WSYC-FM in good standing
  • Responsible to the Program Director

Section 11: Production Engineer

DUTIES:
  • Responsible for activities that take place in the production studio
  • Responsible for all WSYC-FM produced materials
  • Responsible for training a production staff
  • Must approve all non-music production, including promos, PSAs, liners and donorships, before being logged for airplay
  • Create and enforce rules for the production studio
  • Keep the production studio in a clean and orderly fashion
  • Assist any full station member with production work if needed or requested
  • Responsible for maintaining an archive of promos, PSAs, liners, donorships, and station identification material
  • Must create PSAs, promos, station identification material, and station liners
  • Must be a full member of WSYC-FM in good standing
  • Responsible to the Program Director

Section 12: Public Relations Director

DUTIES:
  • In charge of gaining favorable publicity for the station
  • In charge of poster requests and campaigns
  • Responsible for any news releases concerning WSYC-FM
  • Responsible for positive university rapport
  • In charge of producing a station newsletter monthly
  • Coordinate and carryout all giveaways and other promotions for the station (in conjunction with the Music Director if necessary)
  • Coordinate and carryout all tradeouts and fund-raisers in conjunction with the Community Contributions Director
  • The Public Relations Director is in charge of the Public Relations Assistant(s). The Public Relations Assistant(s) will be chosen by the Public Relations Director, and perform tasks the Public Relations Director deems necessary
  • Must be a full member of WSYC-FM in good standing
  • Responsible to the General Manager

Section 13: Music Librarian

DUTIES:
  • In charge of maintenance of both the active and archive music libraries
  • Maintain perfectly alphabetized libraries
  • Repair or replace damaged album jackets or CD jewel cases
  • Put away music that has not been filed, and report offenders to the Assistant Program Director
  • Maintain a database of WSYC-FM's music
  • The Music Librarian is in charge of the Music Librarian Assistant(s). The Music Librarian Assistant(s) will be chosen by the Music Librarian, and will perform tasks the Music Librarian deems necessary
  • Must be a full member of WSYC-FM in good standing
  • Responsible to the Program Director

Section 14: Sports Director

DUTIES:
  • In charge of all sports reports, taped or written, and all live sports broadcasts
  • Train and clear sportscasters for on-air work
  • Coordinate promos for upcoming sports events
  • Work closely with News Department
  • Produce weekly sports summary
  • Critique sportscasters on broadcast performances
  • Must coordinate all remote set-ups and contact host universities for away broadcasts, in conjunction with the Chief Engineer
  • Make sure all preparations are completed for broadcasts before the day of the event
  • Contact University Sports Information Department for releases and statistics
  • Responsible for maintenance and upkeep of "Sports Director's Handbook"
  • Must be a full member of WSYC-FM in good standing
  • Responsible to the Program Director

Section 15: Traffic Director

DUTIES:
  • Daily prepare the program log (maintain copies of the log)
  • Weekly prepare the EAS log (maintain copies of the log)
  • File completed daily program logs
  • File EAS logs in the public file
  • Maintain and upkeep live PSAs and Community Currents
  • Work with production engineer and Community Contributions Director in conjunction with promos and donorships
  • Must be a full member of WSYC-FM in good standing
  • Responsible to the Program Director

Section 16: Public Affairs Director

This position is to be held by an SU Student or by a graduate assistant(s). The holder of this position will help to meet WSYC's community service needs with specialized programming.

If a graduate assistant(s) holds this position they will serve as a non-voting member of the Management Council, as well as advisor(s). The graduate assistant(s) will turn out the programs mentioned above in accordance with their university contract. In addition, graduate assistant(s) may serve as General Manager during the summer terms. However, the graduate assistant(s) may not make emergency expenditures of money or make decisions that will affect WSYC-FM during the school year without first contacting the General Manager.

ARTICLE VI

ELECTED OFFICERS (EXECUTIVE COUNCIL)

Section 1:

The election of officers shall be conducted by station members during the third week of November. Station members shall be notified of an election meeting at least two weeks in advance. Nominations from the floor will be accepted only at the station meeting previous to the election meeting (exception: Article VI, Section 9).

Section 2 :

The term of all elected officers will run from December 1 until November 30 of the following year.

Section 3:

A list a nominees must be posted at least one week in advance. If a nominee wishes to withdraw from the list, the General Manager must be consulted, and a new list will be posted (exception: Article VI, Section 9).

Section 4:

Only full members of the station in good standing of at least sophomore status or at least 25 credits at the start of your term are eligible to serve as Personnel Director, Program Director, or General Manager. Any elected General Manager may only serve a maximum of two (2) consecutive terms. In addition, all members of the Executive Council must have at least a 2.0 GPA during their term of office. No member may serve on the Executive Council if scheduled to graduate at the end of the semester the term expires. Also, no member may run for just one semester.

Section 5:

All candidates shall have the opportunity to present their campaign speeches at the election meeting with no time limitation. The incumbent, if any, shall speak last. After each speech, voters will be able to ask questions of the candidate. All candidates, but the last to speak, shall have the option of a two minute rebuttal. Immediately following the rebuttal period, the voting will transpire.

Section 6:

The candidate receiving over 50% of the votes shall be elected. If over 50% of the votes are not received on the first ballot, the two candidates receiving the largest number of votes will be placed on the second ballot. If there is a tie after the second ballot, additional elections will be held until a winner is declared.

Section 7:

Three tellers shall be appointed by the Executive Council. Candidates are not eligible to be tellers. The tellers announce the winners. Results are then turned over to the station advisor for verification.

Section 8:

During the transition period, there shall be four meetings of the old and new Executive Council officers on four separate dates: two meetings before December 1, one meeting after December 1 before the end of the fall semester, and one meeting between the start of the spring semester and February 1. Both new and old Executive Council officers shall attend these meetings. The time for these meetings should be set by both old and new General Managers. The old Executive Council officers should pass on to the new Executive Officers copies of the Constitution, job descriptions, and any files which will aid in an orderly transfer of officers. The materials should be turned over to the new Executive Council officers at the earliest date. Also, all files which include minutes, manuals, guides, scrap books, etc., should be turned over to the proper members of the Executive Council.

Section 9:

In case of the need for replacement of an elected officer, the nomination and election of the replacement shall take place at the earliest station meeting; However, no election shall take place unless at least 72 hours notice has been given to the impending election to the station members. Any member who wishes to run for a vacant position will submit their name to the Executive Council no later than 24 hours before the meeting. This will serve as a nomination. The Executive Council will then post a list of eligible candidates. The election will then take place at the meeting as if it were a regular election meeting. During a time period where a vacancy exists on the Executive Council, the Executive Council shall overlap jobs until such time when elections can be held. In the case of the need for the replacement of the General Manager, the Program Director will assume the General Manager's duties until the said election takes place. The Executive Council may appoint someone to serve as an interim Executive Council member until an election can be held. An Executive Council member may run for the vacant office, but must resign his or her present office immediately.

ARTICLE VII

APPOINTED OFFICERS (MANAGEMENT COUNCIL)

Section 1:

Appointed officers are designated by the Executive Council. The number of appointed officers may vary with the needs of the station. The term of office for all Management Council members is from the third full week of August to the second full week of December, and the third full week of December to the second full week of August, for the fall and spring semesters respectively. Management Council members, as well as the Executive Council members, are not required to fulfill their duties during the summer break. The procedure for selecting Management Council members is as follows:

  1. Any full member who wishes to become a member of the Management Council shall submit an application no later than the date set by the Executive Council.
  2. During the third full week of April and the third full week of November, the Management Council elections will take place for the fall and spring semesters respectively. The voting members shall be the Executive Council and the outgoing Management Council. Any Management Council member who is running for another Management Council position(s) may not cast a vote for the position(s) in question. In the case of voting for the Spring semester, the former General Manager shall also be at the election in an advisory role.
  3. Each candidate shall be prepared to make a speech to the Management Council explaining why they wish to become a Management Council member, and what they hope to accomplish. All candidates for each office will be permitted to speak. After all candidates are finished with their speeches, the Management Council will discuss the candidates and then vote by secret ballot. In the case of voting for the spring semester, the former General Manager will count the votes , and the candidate with over 50% of the votes will be the winner. If no candidate receives over 50% of the vote, the two candidates receiving the largest number of votes will be placed on the second ballot. After the second ballot, if there is a tie, the Executive Council will vote by secret ballot to break the tie.

Section 2:

After the Management Council elections, there will be two meetings of the old and new Management Councils. Within those two weeks the old Management Council will train the new Management Council members. At the first meeting, any minutes, files, memos, etc., should be turned over to the new Management Council.

Section 3:

At the beginning of each term of the Management Council and with the creation of each newly appointed office by the Executive Council, a job description shall be written for each appointed office by the Executive Council member affiliated with each office. A description will also be listed and filed by the General Manager.

ARTICLE VIII

RECALL OF OFFICERS

Any member of WSYC-FM may institute recall proceedings against any member of either the Executive or Management Council by submitting to the General Manager (or Program Director in cases of General Manager recall proceedings) a recall petition signed by 1/3 of the membership. An officer shall be considered recalled when, at a station meeting of which due notice of recall proceedings has been given to the members at least one week in advance, 2/3 of the entire voting membership uphold the petition. For any officer to be recalled, it must be shown that the officer willfully violated the station Constitution and/or jeopardized the FCC station license. The recall proceeding shall follow the following guidelines:

  1. Petition shall be read by the General Manager; in cases where the General Manager is recalled, the Program Director will read the petition.
  2. The writer of the petition will be given the floor to state the reasoning for the petition and state any additional comments (10 min. max).
  3. Recalled officer will then have time to respond to the accusations made against them and defend their position (15 min. max).
  4. Open floor debate of all members shall follow (15 min. max).
  5. The recalled officer will then have 5 minutes to conclude their defense and rebut accusations.
  6. The recalled member must leave the room.
  7. The General Manager or Program Director (in cases of General Manager recall) will then appoint three Management Council members to collect and count votes.
  8. The three members will then hand the General Manager, or Program Director, the vote totals and the decision will be announced to the members and the officer recalled.

ARTICLE IX

AMENDMENTS

Amendments to the Constitution may be submitted to the General Manager at any general meeting of the station. A period of one week must lapse between proposal and vote; and if approved by a 2/3 majority of the voting membership, they shall be considered part of the Constitution.

ARTICLE X

RATIFICATION

This Constitution shall be considered in effect as soon as 2/3 of those present and voting at a meeting identified by proper notification as a constitutional meeting shall ratify it, and it has been approved by the Student Association.
